As the data controller we pay utmost care to the security of your personal data. With this in mind, we pay attention to the processing and storrage of all individuals including those who have benefited from our product and services wthin our field of expertise in accordance with the Personal Data Protection Law No. 6698 ("KVK Law"), the "Regulation on the Processing and Confidentiality of Personal Health Data" and the relevant legislation. With the full understanding of this responsibility, as a Data Controller, we process your personal data as described below and within the limits ordered by the legislation.

ARTICLE 3- Definitions

a) Explicit consent: Consent on a particular subject, based on information and expressed freely, 
b) Anonymization: Making personal data in no way relatable to a specific or definable real person even by means of  matching with other data. 
c) President: The President of the Personal Data Protection Authority, 
ç) Relevant Person: The real person whose personal data has been processed, 
d) Personal data: Any information regarding the identified or definable real person, 
e) Processing of personal data: Any processing of personal data, such as obtaining, recording, storing, preserving, altering, rearranging, disclosing, transferring, inheriting, making available, classifying or preventing the use of personal data by non-automated means, provided that it is fully or partially automated or part of any data recording system, 
f) Board: Personal Data Protection Board, 
g) Institution: Personal Data Protection Agency, 
ğ) Data processor: The natural or legal person who processes personal data on his behalf based on the authority granted by the data controller, 
h) Data recording system: The recording system in which personal data are structured and processed according to certain criteria,
i) Data controller: Refers to the natural or legal person who determines the purposes or criteria for the processing of personal data and is responsible for the establishment and management of the data recording system.

Obtaining Personal Data:
Your personal data is obtained by postings you have made on the website or social media in oral, written, visual, auditory, electronic environment if you request information and documents for protection of public 
health and the execution of preventive medicine services, the execution of medical diagnosis, treatment and care services, all kinds of services offered by the data controller, both in person and in your online application. 

PROCESSING OF PERSONAL DATA:
Within the scope of our activities as a data controller, the    Identity Data, Communication Data, Finance data, Product servicer/ patient/ customer data, Audiovisual records, signature data concerned people are being kept. 
In other words, the personal data you share with your consent include First Name, Surname, T.C. Identification Number, Passport number, temporary TC identification number, marital status, occupation, Gender, Date of Birth, e-mail address, phone number, address information, bank account/ IBAN information, credit card and payment information, patient protocol number, data on private health insurance for the purpose of financing and planning health services, Social Security Institution data, Appointment Date, Appointment Time, Processing Personnel,  information about the procedure, patient medical report, laboratory results, test results, examination information, examination fee information, allergy information, check-up information, doctor's analysis and interpretations, diagnosis, diagnostic, used and recommended medications, prescription information, photo and visual records, including, but not limited to, during and/or as a result of the execution of treatment and care services for medical diagnosis  and your personal data on sex life, IP address information, voice call recordings held in accordance with call center standards, camera recording images held for security and audit purposes during the data controller visit, cookie data you have shared by means of sending data to the website/and filling out a form. 

PROCESSING PURPOSES OF PERSONAL AND SPECIAL PERSONAL DATA PROCESSED: 
Aforementioned personal data/ personal data of special quality; is recorded, stored, stored and processed in a limited and balanced manner, in accordance with the purpose that requires them to be processed and in connection with this purpose, while maintaining its up-to-datedness for the following purposes.

The data is also collected electronically and/or physically for the purposes clearly stated in the law. 

In addition to this, in order to prevent the possession of your personal data/ privately qualified personal data by others, identification and verification, protection of public health, preventive medicine, medical diagnosis and treatment and the execution of care services, planning and management of health services and financing, supply of necessary medicines and/or medical supplies and/or devices, planning and management of health services and budgets, sharing the information requested with the Ministry of Health and other public institutions and organizations in accordance with the relevant legislation,  sharing the requested information with private insurance companies and contracted institutions, sharing the information and document transfer requested by private insurance companies or contracted institutions within the scope of the financing of health services, and following the process, billing in return for the health services offered and establishing relations with the contracted institutions, sharing information and documents on a patient basis and in accordance with the legislation,  your data is recorded, stored, stored and processed in order to record incoming calls by the call center and to measure customer satisfaction.

TRANSFER OF PERSONAL AND SPECIAL PERSONAL DATA PROCESSED:
In accordance with Article 8 of the Law, personal data obtained for processing within the framework of the general principles specified in the law will be transferred to the 3rd persons by obtaining the explicit consent of the person concerned. In addition, the Company will be able to engage in data transfer activities in cases where personal data can be transferred without seeking the explicit consent of the person concerned as stipulated in the Law.

In this context;
1-Terms of Domestic Transfer of Personal Data are as follows,
• If it is clearly stipulated in the law,
• If it is necessary to protect the life or body integrity of the person who is unable to disclose his or her consent due to actual impossibility or whose consent is not legally valid,
• If the processing of personal data belonging to the parties to the contract is necessary, provided that it is directly related to the establishment or performance of a contract,
• If it is mandatory for the data controller to fulfill its legal obligation,
• If it has been made available to the person concerned,
• If data processing is mandatory for the establishment, exercise or protection of a right,
• If data processing is mandatory for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the person concerned,

-Terms of Domestic Transfer of Personal Data of Special Quality
• In case of obtaining the explicit consent of the person concerned,
• If it is clearly stipulated in the law in terms of personal data of special quality other than health and sex life,
• In terms of personal data related to health and sex life, within the scope of the protection of public health, preventive medicine, medical diagnosis, treatment and maintenance services, planning and management of health services and financing, the processing by persons or authorized institutions and organizations under the obligation to keep secrets,

Your personal data can be shared under the conditions determined by the law and other legislation and for the purposes mentioned above with our company and private insurance companies, ministry of health and affiliated sub-units, social security institution, general directorate of police and other law enforcement agencies, general directorate of population, Turkish pharmacists association, courts and all kinds of jurisdictions, central and other third parties, lawyers and other representatives you have authorized,  with third parties with whom we receive consultancy, including tax and financial advisors and auditors, regulatory and supervisory institutions may be shared with other third parties, including official authorities, to develop or carry out health services for the purposes set out above, not contrary to the KVKK.

RELATED LEGISLATION:
As explained above, your personal data is processed in all kinds of oral, written, visual or electronic media with the above-mentioned purposes and the legal conduct of all kinds of work including the activity of The Trust Health Group Companies. Your personal data is collected and processed in order to perform its contractual and legal obligations fully and properly. The following are among the legal reasons for collecting your data:

• Law no. 5651 on the Regulation of Publications made on the Internet and the Fight against Crimes Committed Through These Publications,

• Social Services Law No. 2828,
• Private Pension Savings and Investment System Law No. 4632,
• Regulation on Health and Safety Measures to be taken in Workplace Buildings and Add-ons,
• Regulation on State Archive Services,
 occupational Health and Safety Services Regulation,
• Health Services Basic Law No. 3359,
• Decree no. 663 on the Organization and Duties of the Ministry of Health and its Subsidiaries,
• Other secondary regulations in force in accordance with these laws are stored and processed for the periods stipulated within the framework.

In addition, care is taken to provide standards in accordance with the European Union personal data protection legislation, especially the General Data Protection Regulation of the European Union, taking into account that we provide services to patients connected to the European Union and have commercial relations with individuals and institutions.

As stated in the KVKK, personal data related to health and sex life can only be processed by persons or authorized institutions and organizations under the obligation to keep secrets for the purpose of protecting public health, carrying out preventive medicine, medical diagnosis, treatment and care services, planning and management of health services and financing, and acting in accordance with the legislation.


CONCERNED PERSON'S RIGHTS:
The rights of the person concerned are explained in the clarification text published on the data controller's website. In addition, section 11 of law No. 6698 is indicated below. 

Rights of concerned person
ARTICLE 11- 
(1)    Everyone is entitled to contact the data controller and request the following:

a) To find out if personal data has been processed, 
b) Requesting information about personal data if it has been processed, 
c) To learn the purpose of processing personal data and whether they are used in accordance with their purpose, 
ç) To know the third parties to whom personal data are transferred at home or abroad, 
d) Request correction of personal data in case of incomplete or incorrect processing, 
e) Request the deletion or destruction of personal data within the framework of the conditions stipulated in Article 7,
 f) Request notification of transactions made in accordance with paragraphs (d) and (e) to third parties to whom personal data are transferred, 
g) Objecting to the emergence of a result against the person himself by analyzing the processed data exclusively through automated systems, 
ğ) In case of damages due to the unlawful processing of personal data, the right to rectified the damages.
